TERMS OF SERVICE/FAQ

All clients of Xmera Den Productions are expected to read and agree to the points below before service.

TERMS OF SERVICE

The client agrees to cover an initial fee (half the full payment) to commission a design, art piece or video edit.
The client won't receive any high-quality files until the remainder of the cost is acquitted.
While the project is in progress the client can't share any design approaches with other designers or artists to replicate or modify.
Once the transaction is done, the client accepts he/she is satisfied with the design provided and the price established.
There are no refunds of the initial fee or the remainder of the cost once it's paid.
After the payment is done the client will receive the original file together with any other file he/she requires.
The client can request minor changes to the design any time he/she desires during the service time.
The client has full commercial ownership of the design with all the rights it entails.
The designer/artist keeps the author's moral rights to promote and display the work as made by her.
The client can't promote himself/herself as the creator of the design/art.
All unused design/art approaches belong to the designer.
The designer/artist can re-use, recycle, modify, share or sell any unused design approaches.
The client can redesign, modify or alter the design/art in any way he/she wants. The designer/artist will only keep author rights over the original design.

WORK PROCESS

Please send an email to krysta@xmeradenproductions.com with the following information:

For Logos

Name of the Project/Logo
Name of the owner of the copyrights (Full Name, Company Name or alias) This name will be referenced by the designer on his online portfolios.
A brief about the company, service, character or any other pertinent information for the realization of the design.
Specify if the design will be an Icon (Image only), Word Mark or Logotype (Signature) and Combination Mark (Text and Image).
Please specify if you need the logo in CMYK (Printing) or RGB (Websites) color format.
Set a deadline for the conclusion of the project. Please consider a minimum of four weeks is required.
An email address linked to Paypal.
Please specify if you wish to use the Vault Service.

For Art Commissions

When available, an art sheet will appear in the commission tab illustrating pricing & art styles/specials for sale.
For character art the client will provide a reference for the artist. (Color/pose may be requested)
If no reference is given or the character must be built from the ground up, additional fees may be charged.
The artist has the right to decline a commission if the artist does not feel comfortable with the brief content or feel they may not be able to complete the task to the clients expectations.
All payments made via paypal
By default the piece will be in RGB. The client should specify or request a CMYK file for printing.

For Video Editing

Leave a summary/brief of what the video is and how you would like it to be structured (documentary, trailer, music video, etc.)
Initial price of the by the length of the video and additional charges may be applied for additional assets not provided by the client. (EX: Illustrations, FX, etc.)
By default the video will be redered in MP4. format and the client should specify otherwise.

INTELLECTUAL PROPERTY RIGHTS

This is a professional service. All designs are protected under the Digital Millennium Copyright Act, the Creative Commons and their Intellectual Property Rights of each country where these designs are registered by their rightful owners. If you try to use one of these designs without permission you are subject to legal actions.

HOW LONG DOES AN AVERAGE PROJECT TAKE?

For Logos and Illustration, first or multiple drafts may be made within the first 24-72hrs and sent for approval or adjustments before moving forward to a final product.

Time of delivery may vary depending on work load please allow for 1-2 weeks for completion.

Video editing may greatly very depending on the type of edit. A typographic video with illustrations/animations may take 2-5 weeks while a short edited video or content provided for editing may take 1-2 weeks depending on length of the video. Please be aware that fix's or extreme changes to the video may be subjected to additional charges

HOW IS PAYMENT HANDLED?

All payment is through paypal.

To better protect the designer/artist a deposit of half the estimated charge is expected at the start of a project and the final payment at the end before all files are transferred.

Please do not send payment until a note or invoice has been sent first.

Deposit not refundable.

Once payment is payed it full I will send over the files via dropbox for download.

WHAT IS YOUR DESIGN PROCESS?

For Art: After receiving the brief, I will get started working on one or more conceptual pieces that will be sent for approval before moving onto the final product.

For Video Production: I will give updates of milestones and will send pre-rendered parts for approval/opinions or sent upon request.

WHAT FILES WILL I RECEIVE?

Designs will recive a zip file conating a package.

The package will include: AI file, an EPS file, PNG of the design, an alt color PNG and a B&W PNG - 6 files

Illustrations/Art- A PS/CSP file and high quality PNG or JPEG

Video- MP4 file

CAN I USE THE LOGO/ILLUSTRATIONS/VIDEO I COMMISSIONED ON OTHER WEBSITES?

Yes! You can use the logo/Illustrations/video however you want.

CAN I COMMERCIALIZE THE DESIGN?

Yes. All commercial rights belong to you the moment full payment is made. That's why I send the original editable files. While you commercialize the design, you can't promote yourself as the creator of the design.

CAN I RESELL THE DESIGN?

Yes. As mentioned before you own all commercial rights, including selling the identity/brand.
